Why oh why does Halo's engine have to be proprietary...

We all know it, so why don't we all just admit it? Halo PC and CE's game engine is old. Very old. Yes, OpenSauce, TexMod, Reshade, and other projects have made the graphics a lot better, but the stagnant graphics are still there. And the worst part is, Halo CE/PC's EULA says that we "may not reverse engineer, decompile, or disassemble" the game. Which includes the engine. I was thinking about updating the engine with maybe a cryengine-like type, but alas, I would never be able to distribute it.
